1. CONDITIONS
This position shall be covered as a Bargaining Unit Position with the Union Local 99. Employee may be discharged at any time for cause or without cause. There is no minimum duration of employment guaranteed to Employee. This position description shall not create a contract between Natural Rx entitling Employee to recover specific or general damages for Employer’s breach of any employment related obligation, whether under law or by way of contract. In the event Employee is entitled to recover specific or general damages for Employer’s breach of any employment related obligation, whether under law or by way of contract, such damages shall be limited to the equivalent of six (6) months’ salary of Employee, inclusive of any claims for special damages, general damage, compensatory damage, loss of income, emotional damage, or punitive damages.
Employment in this position is contingent upon Employee obtaining and keeping at all times a Department of Health LNPP Employee Card or equivalent.
FLSA Exempt: This position is not an FLSA exempt management or supervisory position. Employee shall receive overtime compensation for the services performed, to the extent required by law. All over-time must be specifically authorized by a supervisor.
2. DESCRIPTION OF DUTIES
Employee shall engage in tasks necessary to Employer’s operations as a licensed producer of medical cannabis derived products under applicable New Mexico Department of Health administrative regulations, under the direct supervision of the General Manager and/or the Chief Executive Officer.
Employee shall not have the authority to enter into contracts with third-parties on behalf of Employer, nor requisition purchases without management approval.
The essential job functions or duties of this position are as follows but are not limited to:
1. Perform daily pre-opening procedures as directed by Employer.
2. Ensure all medical cannabis product is sufficiently stocked.
3. Turn on computers and peripherals.
4. Verify operation and functionality of computers and peripherals.
5. Open store front per company procedures.
6. Greet patients and assist them in filling their orders.
7. Educate and assist co-workers as necessary.
8. Perform end of day store cleanup per company procedures.
9. Perform end of day store closure and security check.
10. Handle and transport medical cannabis and CDPs in accordance with Employer policies and procedures, and applicable legal standards.
11. Maintain any personal certifications or licensures that are required for Employer’s Department of Health license.
12. Must stay current on strains and medical uses for each strain
13. Must read, train and stay current on DOH policy.
14. Must read, train and stay current on Company policy, procedure and requirement.
15. Must read, train and stay current on Fulfillment Room policy and procedure.
Employee shall also perform such other duties as are customarily performed by other persons in similar such positions, as well as such other duties as may be assigned from time to time by the Employer.
3. PLACE AND HOURS OF EMPLOYMENT
Duties shall be primarily rendered at Employer’s business premises. Employer may require Employee to engage reasonable in-state or out-of-state travel in pursuit of Employer’s business needs.
Employee’s hours will depend on the Employer’s business needs.
4. QUALIFICATIONS
Mandatory qualifications are as follows:
- No disqualifying criminal convictions.
- Ability to obtain Department of Health LNPP Employee Card or Equivalent.
- Knowledge of federal and state patient confidentiality laws and regulations.
- Knowledge of food safety and CDP-production hygiene standards.
- Knowledge of Department of Health regulations for LNPPs.
Desirable qualifications are as follows:
- Successful prior experience in producing/distributing medical cannabis.
5. PERFORMANCE TERMS
The following performance terms apply to this position:
1. Employee’s efforts will result in Employer obtaining and keeping Department of Health licensure as a medical cannabis producer.
2. Employee’s efforts will enable Employer to offer cost-competitive medical cannabis and cannabis derived products to patients registered with the NM medical cannabis program that are recognized by this clientele base as being of good quality, and will enable Employer to attract business sufficient to maintain operations.
Failure to reach said benchmarks or performance terms may result in reassignment, demotion or termination. Reaching these benchmarks or performance terms constitutes a reasonable and substantial condition of employment but does not in any way guarantee or promise continued employment.
6. COMPENSATION AND BENEFITS
Compensation shall be at an hourly rate, payable bi-weekly. Employer shall deduct or withhold from compensation any and all sums required for federal income and social security taxes, as well as all state or local taxes now applicable or that may become applicable to Employee or Employer in the future.
Employee shall be entitled to reimbursement of any or all expenses authorized and reasonably incurred expenses incurred in the performance of the functions and duties under this Agreement. In order to receive reimbursement, Employee must timely provide Employer with an itemized account of all expenditures, along with suitable receipts therefore.
Professional Licenses and Memberships. Employer may, at its discretion, assist with payment for those certifications, licenses or memberships which both parties consider to be essential to performance of the job.

**Pay goes up to $814 weekly after 90 day probation**

Maintain structure within the Company .Meet with staff to determine tools, training and support needed to succeed in their mission. Oversee staff training as it relates to the Lynn & Erin CUA.
