The DHHS ALJ III / Office Director acts as: an Administrative Law Judge with an assigned caseload; the administrative leader of the office; and the Chief Administrative Officer for all or portions of DHHS GRAMA appeals. This position is part of the DHHS Executive Leadership Team. An Administrative Law Judge III presides over and conducts informal but often complex administrative hearings on behalf of the Department of Health and Human Services regarding the Division of Child and Family Services, the Division of Licensing and Background Checks, the Division of Aging and Adult Services, the Division of Services for People with Disabilities, the Office of Recovery Services, the Center for Medical Cannabis, Medicaid, the Children’s Health Insurance Program (CHIP) or the Primary Care Network (PCN) Program, and other programs as needed
Examples of Duties
Conducts informal hearings and pre-hearing conferences by video, telephone, and in-person.

Rules on the admissibility of evidence, evaluates evidence and makes decisions on cases.

Questions witnesses when necessary.

Makes determination of witness credibility.

Resolves procedural issues and rules on objections to evidence or questions from counsel.

Makes final judgments and issues written decisions in a timely manner.

Questions witnesses when necessary and considers testimony and evidence that is presented.

Issues subpoenas, holds pre-hearing conferences, rules on other legal issues prior to hearing.

Explains procedures and rules that apply to hearings to litigants, attorneys, and others.

Accurately maintains files and records.

Assists in other office duties as needed.

Acts as the administrative director of the office

Supervises other staff and assists with training on best practice
Decides GRAMA appeals for DHHS as the delegated Chief Administrative Officer
Qualifications and Skills
A Juris Doctorate and at least three years of experience practicing law are required

Supplemental Information
A Juris Doctorate is required.

At least three years of experience practicing law is required as well as membership in the Utah State Bar.

Preference may be given to applicants with knowledge and experience in Health and or Human Services Programs, litigation experience, judicial clerkships or prior administrative law experience.

Preference may be given to applicants with one year or more work experience in Medicaid, juvenile court or child welfare and/or prior work experience as an Administrative Law Judge.

Risks found in the typical office setting, which is adequately lighted, heated and ventilated, e.g., safe use of office equipment, avoiding trips and falls, observing fire regulations, etc.
Typically, the employee may sit comfortably to perform the work; however, there may be some walking; standing; bending; carrying light items; driving an automobile, etc. Special physical demands are not required to perform the work.
