This position provides legal support for the Medical Cannabis program in the Department of Health. Medical Cannabis was passed by South Dakota voters in November 2020 and codified at SDCL 34-20G. The Department has worked tirelessly to bring up the program over the last year and a half. The incumbent also serves as a Special Assistant Attorney General. Duties include providing legal opinions and advice to program and department staff; drafting legislation and administrative rules; lobbying; drafting policies and procedures; assisting with the Request for Proposals process; ensuring the Department is in compliance with federal and state statutes and administrative rules; participating in administrative and court hearings associated with regulatory actions involving patient registration and registration/regulation of medical cannabis establishments; providing assistance in drafting contracts and joint powers agreements; and other duties as assigned. This s a unique opportunity to provide legal assistance and support to a developing industry and body of law. The position will provide technical assistance and guidance to staff regarding the administrative rules, promulgation process, and legislative matters.
Travel is required as necessary.
Preferred location is Pierre. If the position is located in Sioux Falls or Rapid City, regular travel to Pierre is required.
Licenses and Certifications:
Graduation from an accredited school of law and a member of the South Dakota Bar or eligibility to sit for the exam is required.
The Ideal Candidate Will Have:
Experience in administrative law and knowledge of medical marijuana programs/legal issues are preferred.
Knowledge of:
- criminal and civil practices and procedures;
- evidence and constitutional law and the current national and state trends;
- state administrative practices and procedures;
- legal research techniques, including the use of technology;
- basic computer operations and applications;
- state and federal statutes related to health care and medical marijuana programs.
Ability to:
- communicate clearly and concisely;
- prepare clear and concise documentation, reports, and correspondence;
- analyze facts, evidence, and precedents and arrive at a logical interpretation;
- work in harmony with program staff, private attorneys, and circuit court officials;
- work independently while following instructions and accepting guidance;
- deal tactfully with others;
- effectively manage a large caseload.
