Duties Description
Reporting to the First Deputy Counsel the incumbent of this position will serve in the Office of Cannabis Management’s Legal Division and will manage a portion of the legal portfolio including but not limited to writing laws and regulations, interpreting statute, pursing litigation against licensees, and general legal responsibilities for the Office. The Associate Counsel provides technical legal assistance and advice to the Executive Director and other executives in the Office. The incumbent interprets laws applicable to the Office and, where appropriate, may issue declaratory rulings.
Duties include, but are not limited to:
- Prepares and represents the Office of Cannabis Management in litigation and administrative proceedings regarding challenges to the Cannabis Law and administrative decisions taken by the Office or Cannabis Control Board.
- Conduct legal research and prepares legal memoranda with opinions and citations and legal precedents in support of Office of Cannabis Management programs.
- Provide legal counsel, advice and strategies in presenting evidence and testimony at litigation and administrative proceedings.
- Conduct legal research and develop and drafts formal legal opinions responding to daily requests arising from interaction with OCM business units or as assigned by the First Deputy Counsel and General Counsel.
- Prepare legal opinions and memoranda for the Office on a variety of legal issues including interpreting the Cannabis Law rules and regulations.
- Conduct legal research and prepares legal memoranda with opinions and citations regarding the legality of actions taken by the Office of Cannabis Management and Cannabis Control Board.
- Participate and assist the Office of Cannabis Management in the design, development, negotiation and implementation of procurement contracts, Memorandum of Understandings (MOU) and Service-Level Agreements (SLA) for the Office.
- Participate and assist the Office of Cannabis Management in negotiating statewide, contracts with vendors, coordinating with the Office of the State Comptroller, Division of the Budget and the Attorney General’s office.
- Assist in the legal matters associated with contracts including preparation of Requests For Proposals (RFPs), related policies, procedures and guidelines, and the design and promulgation of standards for sole source and proprietary agreements, including negotiation protocols.
- Prepare OCM program bill packages as requested including bill summary, text of legislation and supporting memoranda relating to laws affecting the Office. Evaluate, comment and make recommendations on legislative proposals in this area by other agencies and the private sector.
- Prepare as necessary, rules and regulations in support of the Office’s business units including processing in accordance with the State Administrative Procedure Act.

Job Summary

Duties Description
The Chief Hearing Examiner will report to the General Counsel and be responsible for presiding at administrative hearings of an adversarial nature including, but not limited to, preparing post-hearing proposed findings of fact, proposed conclusions of law, and proposed recommendations for review by the Cannabis Control Board.
Duties include, but are not limited to:
- Supervise hearing examiners, including maintaining schedules, assignments, and status tracking.

- Preside over administrative hearings scheduled by the Office of Cannabis Management concerning alleged violations of the Cannabis Law and enforcement thereof.
- Maintain fairness, impartiality, and due process, as set forth in the agency’s applicable rules and regulations, for all parties present at a hearing.
- Manage hearing calendars to ensure all cases are heard and decided in a timely manner as prescribed by applicable requirements.

- Issue, or cause to be issued, subpoenas for the attendance of witnesses and the production of necessary books, records, and other documents, examine witnesses under oath.
- Administer oaths and affirmations.

As a Dispensary Pharmacist, you have the opportunity to use your degree and skills in this unique environment, guiding patients to improve their quality of life while helping relieve their symptoms, giving them the best optimal care.
Job descriptions are, but not limited to, the following:
- Follow all state regulations regarding the dispensing of medical and/or adult-use cannabis products.
- Follow all state pharmacy practice regulations regarding counseling of patients.
- Comply with all inventory control measures set forth by state regulations and by Acreage Holdings SOPs.
- Follow HIPPA guidelines.
- Have a full comprehension of the different components of cannabis, including cannabinoids and terpenes, and how these compounds interact with the endogenous cannabinoid system.
- Able to interpret laboratory results for cannabis products sold; able to use this information to recommend appropriate products to patients.
- Conduct patient consultations in a professional, empathetic manner that will include a:
- Review of a patient's diagnosis and symptoms associated with that diagnosis
- Review of a patient's other health conditions, if applicable
- Monitoring for potential drug interactions and provide counseling/guidance if appropriate
- Check with a patient's previous experience with cannabis-based medicines
- Discussion about the risks and benefits of marijuana use
- Review of the different modes of delivery
- Brief discussion about the components of cannabis to the patient.
- Recommend appropriate products with appropriate dosing based on the information provided by the patient, caregiver and/or physician.
- Follow up with patients via phone conversations and electronic means to document symptom relief, medication changes, and optimal dosing.
- Provide specific training to appropriate staff members.
- Be involved in outreach efforts to market the company and provide accurate information to (but not limited to):
- Community groups
- Patient-support groups
- Providers and healthcare networks
- Universities and colleges
- Be open and available to conduct research projects with different entities, if compliant with all state regulations.
- Complete at least one hour of continuing education yearly that encompasses cannabis medicine.
Mandatory Requirements:
- Bachelor of Science Degree from an accredited School of Pharmacy
- Active pharmacist license, in good standing, from the State of New York
Preferred Qualifications:
- Experience in a retail pharmacy setting.
- At least one year of managerial experience.
- Doctorate of Pharmacy degree from an accredited School of Pharmacy

Additionally, candidates who accept an offer of employment will be provided with instructions for securely submitting proof of COVID-19 vaccination prior to the individual's start date, as well as the Company's process for requesting and completing an applicable medical or religious exemption form. No medical documentation should be submitted to the Company prior to receiving such instructions from the Company's recruiter or other designated human resources professional
