THE POSITION
The Code Enforcement Officer is responsible to investigate and enforce applicable ordinances, codes, and regulations related to, zoning, health and safety, blight, and graffiti involving both office and field work.
DISTINGUISHING CHARACTERISTICS
Code Enforcement Officer I - Neighborhood Preservation Unit: This is the entry level class in the Code Enforcement Officer – Neighborhood Preservation Unit series. Positions in this class typically have little or no directly related work experience. The Code Enforcement Officer I – Neighborhood Preservation Unit is distinguished from the II level by the performance of less than the full range of duties assigned to the II level. Incumbents work under immediate supervision while learning job tasks, progressing to general supervision as procedures and processes of assigned area of responsibility are learned, including routine inspections and investigations.
Code Enforcement Officer II - Neighborhood Preservation Unit: This is the journey level class in the Code Enforcement Officer – Neighborhood Preservation Unit series and is distinguished from the I level by the assignment of the full range of duties, including a variety of investigations, inspections, and related code enforcement activities. Employees at this level receive only occasional instruction or assistance as new, unusual, or unique situations arise, and are fully aware of the operating procedures and policies within the work unit.

ESSENTIAL AND MARGINAL FUNCTION STATEMENTS
Essential and other important responsibilities and duties may include, but are not limited to, the following:
Essential Functions:
Receive, investigate, and respond to complaints of violations of local and state laws, ordinances, codes, and regulations related to zoning, property maintenance, sign violations, health and safety, blight, graffiti, unpermitted cannibas grows or dispensaries, and complaints of mold; coordinate with other departments to determine corrective actions, abate violations, and ensure compliance with City codes.
Patrol assigned area in a City vehicle to investigate and mitigate alleged complaints of violations; proactively identify and investigate violations of City codes, including those relating to zoning, property maintenance, sign violations, health and safety, and any other violations of City codes.
Conduct property inspections; contact responsible persons, interview citizens, photograph evidence, develop and maintain detailed information for case files regarding code enforcement activity to substantiate violations.
Interact with the public in potentially volatile situations; resolve disputes regarding code enforcement matters in a tactful and productive manner.
Research property ownership and lien holders of subject properties as needed.
Perform follow-up investigations to ensure compliance.
Prepare and manage caseloads by maintaining accurate case files, reports, evidence, appropriate notices, letters, memos, and other documentation.
Issue appropriate notices criminal and administrative citations, including notices of violation, courtesy notices, notice and orders to abate, inspection warrants, and code enforcement liens; consult with the Deputy City Attorney, as needed.
Prepare and present cases during administrative hearings or criminal proceedings, as required.
Coordinate and facilitate investigations with other agencies and City departments on the investigation and disposition of cases.
Read, comprehend, interpret, and explain all City codes and applicable state laws codes; explain and educate members of the public on enforcement procedures.
Develop and implement public information and education programs to inform citizens of the programs that the division enforces.
Represent the City during public meetings, City Council meetings, neighborhood forums, and necessary court appearances or administrative hearings.
Drive assigned City vehicles for entire work shift in a safe and knowledgeable manner.
Input daily case reports and evidence and perform other administrative tasks as needed.
Interpret architectural drawings and read blueprints and plot plans to determine setbacks, planned developments, and clear vision triangles.
Prepare evidence, reports, and other documentation necessary to write end execute inspection warrants.
Conduct property inspections; identify and communicate violations of pertinent codes, building safety, zoning regulations, and property maintenance.
Respond to complaints of mold; investigate and determine source of moisture or water intrusion and determine proper corrective actions to resolve the issue.
Receive complaints and identify and inspect unpermitted cannabis grows and dispensaries; collaborate with property owners and other departments to abate violations and bring properties into compliance.
Perform various functions regarding the Rental Housing Inspection program.
Build and maintain positive working relationships with co-workers, other City employees, and the public using principles of good customer service.
Observe and maintain a safe working environment in compliance with established safety programs and procedures.

MINIMUM QUALIFICATIONS
Code Enforcement Officer I – Neighborhood Preservation Unit
Knowledge of:
Safe and efficient work practices related to code enforcement activities.

Experience:
One year of experience dealing with the public in an enforcement, inspection, investigation, or customer service capacity. Experience in the enforcement of municipal codes is desirable.
Training:
High School diploma or GED equivalency, supplemented by college level course work in public administration, business administration, criminal justice, or a related field. Equivalent to an Associate’s degree from an accredited college with major course work in a related field is desirable.
License or Certificate:
Possession of, or the ability to obtain, a valid California driver's license.
Possession of a Penal Code 832 certificate issued by Peace Officer Standards and Training is required by the end of the probationary period.
Possession of a basic code enforcement academy certificate issued by the California Association of Code Enforcement Officers or American Association of Code Enforcement Officers is required by the end of the probationary period.
Failure to obtain any of the required licenses/certificates within the prescribed time may result in release from probation or termination.
Code Enforcement Officer II – Neighborhood Preservation Unit
In addition to the qualifications for the Code Enforcement Officer I - Neighborhood Preservation Unit:
Knowledge of:
Pertinent state and local laws, codes, ordinances, and regulations related enforcement in the areas of zoning, signs, environmental issues, neighborhood blight, nuisance abatement, property maintenance, building, and health and safety.
Basic legal procedures regarding City and County services, programs, and governmental operations.
Principles, practices, methods and techniques of code enforcement including some familiarity with criminal law and enforcement.
Occupational hazards, hazardous materials, and safety practices.
Basic principles, practices, techniques, and methods of report writing and preparation, investigations, research, data and evidence collection and storage, and records maintenance.

THE POSITION
The City of Modesto is seeking a Neighborhood Preservation Supervisor. The Neighborhood Preservation Unit (NPU) is part of the Building Safety and NPU division within the Community and Economic Development Department. NPU is dedicated to continually improving the physical and quality of life conditions for the residents of Modesto’s neighborhoods. Our enforcement team balances enforcement with education and communication with residents to maintain compliance.
The Neighborhood Preservation Supervisor will promote strong community relationships and build partnerships with residents as NPU strives to improve compliance with the Modesto codes and ordinances established to preserve and maintain the visual appeal of the City’s neighborhoods. The Neighborhood Preservation Supervisor will lead a team of four Code Enforcement Officers and two Administrative Office Assistants. The ideal candidate will bring a vision of and a perspective on how to best address code enforcement in Modesto and have a proven track record of relationship building and operational excellence in enforcing complex land use, planning, zoning, and housing codes.

Plan, prioritize, assign, supervise, and review the work of staff involved in the enforcement of codes and ordinances related to zoning, community preservation, blight, encroachment to the right of way, and weed abatement.
Evaluate operations and activities of assigned responsibilities; recommend improvements and modifications; prepare various reports on operations and activities.
Participate in budget preparation and administration; prepare cost estimates for budget recommendations; submit justifications for equipment, materials, and supplies; monitor and control expenditures.
Participate in the selection of staff; provide or coordinate staff training; work with employees to correct deficiencies; implement discipline procedures.
Identify corrective actions to be taken by owner; monitor changes to ensure conformance with codes and regulations; provide information to violators and the general public regarding codes, laws, and ordinances.
Coordinate, document, and maintain records of code enforcement activities; prepare a variety of written reports, memos, and correspondence.
Prepare and present educational information to the public; work with diverse, grass
roots neighborhood groups, leaders, and residents.
Coordinate and prepare municipal code text amendments, policy studies, and analysis related to the programs of the unit.
Interpret architectural drawings and blue prints to ensure conformity with the municipal code; meet with the public and developers on-site to ensure conformity.
Work with the City Attorney's office on code violations; appear in court to testify as a witness to the violation; maintain files of pending and past legal actions and their resolutions.
Inspect permitted and unpermitted cannabis growing operations and dispensaries for compliance with state and local regulations; take enforcement action, as necessary.
Work with other departments on common enforcement problems and investigations.
Coordinate and oversee work with outside contractors and consultants; monitor work performed and associated costs.
Issue permits to commercial business for outdoor displays and promotions.
Assists in the inspection, documentation, and abatement of substandard and dangerous buildings when necessary.
Represent unit on committees, to outside organizations, staff subcommittees, and other groups, as necessary.
Answer questions and provide information to the public; investigate complaints and recommend corrective action to resolve complaints, as necessary.
Build and maintain positive working relationships with co-workers, other City employees, and the public using principles of good customer service.

Completion of California Association of Code Enforcement Officers (CACEO) Module !, Module II, and Module III Academies, or- Five years of experience enforcing codes and passing the CACEO Substituted Service Certification.
